Disclaimer & Limitation of Liability
Our analysis provides a technical baseline for your vessel’s Speed and Consumption claims; however, all final commercial and legal decisions remain the sole responsibility of the client.
1. Technical Nature of the Analysis
All analyses, calculations, data processing, and reports are prepared solely on the basis of the voyage data, documents, and information made available at the time of the review.
The analysis represents a technical evaluation of the provided data and applied methodologies. It does not constitute legal advice, legal opinions, or any binding determination regarding any claim.
2. Limitation of Liability
Under no circumstances shall the company and/or the data analyst be held liable for any loss, damage, or consequence arising from or related to the use of, reliance upon, or interpretation of the analysis, calculations, reports, or any associated materials.
This includes, without limitation:
- Variations in claim amounts (whether increased or reduced)
- Acceptance or rejection of claims by any party
- Commercial decisions taken based on the analysis
- Financial losses, legal costs, arbitration outcomes, or settlement decisions
- Reputational or consequential damages of any kind
3. Data, Methodology & Interpretation
No responsibility is accepted for any inaccuracies, omissions, or differences arising from incomplete data, data omissions, or differing interpretations of voyage data, charterparty provisions, weather data, routing reports, or calculation methodologies.
This includes, without limitation, clerical or technical errors, judgment-based differences, or variations in analytical approach by any party.
4. Scope of Application
This limitation of liability applies not only to the specific claim under review but also to any other claims, disputes, or evaluations, whether related or unrelated, including those concerning different voyages, charterparties, vessels, or any past, present, or future matters arising directly or indirectly from the use of the analysis or report.
5. Recipient Responsibility
The recipient remains solely responsible for verifying the accuracy, completeness, relevance, and applicability of the underlying data, and for any decisions made based on the analysis.
Any use, reliance upon, circulation, submission, or reference to the analysis, in whole or in part, shall constitute full and unconditional acceptance of these terms.
